If the transponder was ON at the time, then LA Center would of been controlling him.
The Transponder would enable a blip on the Radar to be seen in the ATC Center and thus controllable.
If this is the case and it was ON, its a mistake on the Controllers Part.
The F-117 pilot can only do so much. As Magoo said, he relies on good ATC and his eyes. Just LIKE any other strike fighter, most Strikers that do not fight in the air dont have an air-air radar. So theres nothing scary about that.
If the Pilot did not have his transponder on then he was flying illegally as he was flying in the path of a known air route endangering lives. Relying on his eyes only over California is asking for trouble.
I think an F-117 Pilot is much more responsible than that, otherwise he wouldnt be flying the Nighthawk.

I Also think that the news teams over estimate half of the story to make it look good on air. Its been done before.
