That lack of judicial oversight may not actually be. In 2008, SCOTUS ruled that prisoners held at Gitmo have the Constitutional right of habeas corpus, which is the right to stand before a judge to confront the charges against you as a prisoner. While this may seem like a technicality, it is likely that eventually this ruling will be construed to mean that prisoners held at any offshore military base also have Constitutional rights.
